About My League Terms of Use

By using the aboutmyleague.com website ("Service"), all services of LickityClik ("LickityClik"), you are agreeing to be bound by the following terms and conditions ("Terms of Use").

LickityClik reserves the right to update and change the Terms of Use from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Use. Continued use of the Service after any such changes shall constitute your consent to such changes. Violation of any of the terms below will result in the termination of your Account. While LickityClik prohibits such conduct and Content on the Service, you understand and agree that LickityClik cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

Account Terms

  • Due to the Children's Online Privacy Act of 1998, you must be 13 years or older to register for this Service as an account owner.
  • You must be a person. Accounts registered by "bots" or other automated methods are not permitted.
  • You must provide your legal full name, a valid email address, and any other information requested in order to complete the registration process.
  • You represent and warrant that (a) all the information provided by you to LickityClik to participate in the Service is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.
  • Only one person may use each user login Ð a single login shared by multiple people is not permitted. The account owner may create separate logins for as many people as he/she would like.
  • Every user is responsible for maintaining the security of his/her account and password. LickityClik cannot and will not be liable for any loss or damage from user failure to comply with this security obligation.
  • The account owner is responsible for all content posted and activity that occurs under his/her account (even when content is posted by others who have logins under the account).
  • You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by LickityClik; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent others from using the Service; or (iv) use the Service for any fraudulent or inappropriate purpose. Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences. LickityClik reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request.

Payment and Refunds

  • You may sign up for a free 30-day trial Account with no obligation.
  • You are entitled to only one 30-day trial Account.
  • If you wish to continue using the Service after your 30-day trial period, you must provide a valid credit card or other form of payment accepted by PayPal.
  • PayPal is the payment processor for LickityClik, makers of About My League.
  • You do not need a PayPal account to pay through PayPal.
  • Payments by check or money order will be handled on an as-needed basis. If you would like to pay by check or money order, please Contact Us.
  • If you provide a valid credit card during the 30-day trial period, you will be billed for one year of Service the 30th day after your trial Account was created. If you cancel your Account after providing a valid credit card and before your 30-day trial period expires, you will not be charged.
  • If your 30-day trial period or your one-year Service term expires before you provide a valid credit card, access to your Account will be suspended but LickityClik will retain your Account data for 60 additional days, after which your Account will be terminated. If you provide a valid credit card within this 60-day period, you will be billed for one year of service starting on the date your Account was suspended, and access to your Account will be reinstated.
  • You will be notified by the Service 30 days before your one-year subscription to the Service expires.
  • Refunds will be granted on a pro-rated basis if you Cancel your account. The refund amount is calculated on the day you cancel your Service using the following formula: per-day rate ($239 divided by 365 days equals $0.65 per day) times the number of paid, unused days on your account. Refunds will be granted within 30 days of cancellation by the original method of payment. (See Cancellation and Termination below.)
  • All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.

Cancellation and Termination

  • The Account Owner is solely responsible for properly canceling the Account. An email or phone request to cancel the Account is not considered cancellation. The Account Owner can cancel at any time by clicking on the Account link in the global navigation bar at the top of the screen. The Account screen provides a no-questions-asked cancellation link.
  • All of your Account Content will be immediately deleted from the Service upon cancellation. This information cannot be recovered once your Account is cancelled.
  • If you cancel the Service before the end of your current billing year, your cancellation will take effect immediately and your refund amount will be calculated. (See Payment and Refunds.)
  • LickityClik, in its sole discretion, has the right to suspend or terminate your Account and refuse any and all current or future use of the Service, or any other LickityClik service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. LickityClik reserves the right to refuse service to anyone for any reason at any time.

Modifications to the Service and Prices

  • LickityClik reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  • Prices of all Services, including but not limited to annual subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the About My League site (www.aboutmyleague.com) or the Service itself.
  • LickityClik shall not be liable to you or to any third party for any modification, price change, suspension or discontinuation of the Service.

Copyright and Content Ownership

  • You acknowledge that LickityClik owns all rights, title and interest in and to the Service, including without limitation all intellectual property rights, and such rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any Content from the Service.
  • The rights of LickityClik do not include third-party content used as part of the Service, including the content of communications appearing on the Service.
  • LickityClik does not claim any ownership in any of the Content, including any text, data, information, images, photographs, music, sound, video, or other material, that you upload, transmit or store in your Service Account. We will not use any of your content for any purpose except to provide you with the Service.
  • LickityClik takes no responsibility for third-party content (including, without limitation, any viruses or other disabling features), nor does LickityClik have any obligation to monitor such third-party content. LickityClik reserves the right at all times to remove or refuse to distribute any content on the Service, such as content which violates the terms of this User Agreement. LickityClik also reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this Agreement, including investigation of potential violations hereof, (c) respond to user support requests, or (d) protect the rights, property or safety of LickityClik, its users and the public. LickityClik will not be responsible or liable for the exercise or non-exercise of its rights under this agreement.

General Conditions

  • Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
  • Technical support is only provided to paying account holders and is only available via email (we try to respond within one business day).
  • You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, LickityClik, or any other LickityClik service.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by LickityClik.
  • LickityClik may, but has no obligation to, remove Content and Accounts containing content that LickityClik determines in its sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any LickityClik customer, employee, member, or officer will result in immediate account termination.
  • You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
  • You must not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • If your bandwidth usage exceeds 1 GB/month, or significantly exceeds the average bandwidth usage (as determined solely by LickityClik) of other About My League customers, we reserve the right to immediately disable your Account until you can reduce your bandwidth consumption.
  • LickityClik does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, and (v) any errors in the Service will be corrected.
  • You expressly understand and agree that LickityClik shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if LickityClik has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) or any other matter relating to the Service.
  • The failure of LickityClik to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitute the entire agreement between you and LickityClik and governs your use of the Service, superceding any prior agreements between you and LickityClik (including, but not limited to, any prior versions of the Terms of Use).
  • You agree to hold harmless and indemnify LickityClik and its subsidiaries, affiliates, officers, agents, and employees from and against any third-party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, LickityClik will provide you with written notice of such claim, suit or action.
  • This User Agreement will be governed by and construed in accordance with the laws of the State of Maine, without giving effect to its conflict of laws, provisions or your actual state or country of residence. Any claims, legal proceedings or litigation arising in connection with the Service will be brought solely in Cumberland County, Maine, and you consent to the jurisdiction of such courts.
